Non-Executive Directors - Total Inactivity and Causation of Loss
In this article Andrew Bowen examines the liability of non-executive directors in company fraud cases. He looks at the case of Lexi Holdings Plc (in administration) v Luqman [2008] which raises questions about the suitability of family members as non-executive directors and emphasises the difficulty of establishing liability.
