Misuse of Confidential Information, Restrictive Covenants and Barring-Out Relief
In this article, Andrew Bowen of Terra Firma Chambers examines the case of Caterpillar Logistics Services (UK) v Crean [2012] EWCA Civ 156 where the Court of Appeal considered an attempt by the employer to apply for barring-out relief as a substitute for an express restrictive covenant.
