Author: Andrew Bowen KC
In this article, Andrew Bowen of Terra Firma Chambers examines the case of Caterpillar Logistics Services (UK) v Crean [2012] EWCA Civ 156 where the Court of Appeal considered an attempt by the employer to apply for barring-out relief as a substitute for an express restrictive covenant. This article originally appeared in issue 118 of W. Green's Business Law Bulletin (June 2012) and is reproduced here with their kind permission.
