Stephen O'Rourke of Terra Firma Chambers acted for the respondents (Trustees for Richard Gerald Associates) in the successful opposition to an application to the Lands Tribunal for Scotland. The applicants sought renewal of a title condition (under section 90(1)(b)(i) of the Title Conditions (Scotland) Act 2003) which had been subject to a notice of termination under section 20 of the Act ("Sunset Rule").
