The Scottish Government has granted consent and deemed planning permission for one of the largest on-shore wind farms in the UK following a Public Inquiry in which Counsel from Terra Firma Chambers were instructed on both sides. The proposed development of Dorenell wind farm on the Glenfiddich Estate comprises 59 wind turbines with a generating capacity of 177 MW.  Approval for the development came despite opposition from Moray Council, the Cairngorm National Park Authority and others with Terra Firma Chambers members representing the developers Infinergy and the CNPA at the resultant public inquiry held during October and November 2010.

Statutory consultee Moray Council had objected to the original application on the grounds that it conflicted with its strategy for wind farm location.  The appellant’s arguments strongly criticising the Council's wind farm policy were upheld by the Scottish Ministers.  In addition to consent and deemed planning permission being granted, partial expenses were also awarded including sanction for Senior Counsel.  It is believed this is the first time this has happened in a major wind farm appeal in Scotland.
