James Findlay and Robert Skinner, who recently joined TFC, representing BP and Tesco respectively succeeded in challenging separate decisions of Falkirk Licensing Board refusing licences for a BP Connect store and a Tesco store both with attendant petrol filling stations. The Sheriff found that the Board has applied a test that was too strict, amongst other errors, and remitted both applications to the Board to consider further in the light of his ruling, awarding the successful appellants their expenses against the Board.
