Douglas Armstrong QC represented the Petitioner and Stuart Gale QC represented the Respondents in Jermon Ltd v West Dunbartonshire Council & Anr [2008] CSOH 76 where the Petitioners successfully challenged certain decisions of the Council on the basis that there had been a misdirection by the Council in deciding not to notify certain proposals to the Scottish Ministers in terms of the Town and Country Planning (Notification of Applications) (Scotland) Direction 2007.
