The Home Office errs in law
In a decision delivered orally today Lady Wise agreed that the Home Office had erred in law when refusing to treat a petitioner's further submissions as a fresh claim in terms of Paragraph 353 of the Immigration Rules. The petitioner had obtained documents which demonstrated that he had been sentenced to death in Iran due to his political activities. Despite having obtained those documents the Home Office refused to treat the new evidence as a fresh asylum claim. Stephen Winter of Terra Firma Chambers acted for the petitioner.
