Gordon Steele QC and Alasdair Burnet represented the Petitioners and Douglas Armstrong QC represented the Second Respondents in Bellway (Scotland) Limited and Others v Stirling Council & Walker Group (Scotland) Limited [2008] CSIH 42 in which the Petitioners unsuccessfully challenged the Council’s decision to adopt an alteration to the Stirling Local Plan to allocate a site for the construction of 2,500 new houses on the basis that the alteration to the local plan did not conform to the provisions of the relevant structure plan.  To read the decision click here.
