Stephen Winter acted as Junior Counsel in the successful appeal in the Inner House in the case of Vishal Suri v Secretary of State for the Home Department [2017] CSIH 48. Stephen acted for the petitioner in the judicial review in the Outer House which was unsuccessful. However the Inner House overturned the decision made by the Lord Ordinary in the Judicial Review and also reduced the Secretary of State's decision to prohibit the petitioner from being able to appeal to the First Tier Tribunal whilst he was in the UK. The case centered on the petitioner who was in a relationship with a British national. He applied to remain in the UK on that basis. The Secretary of State refused his application and the refusal did not permit him to appeal whilst in the UK. The petitioner will now be able to pursue his appeal whilst in the UK.
