Stephen Winter successfully represented the appellant in the recent Inner House appeal by AR against a decision of the Upper Tribunal (Immigration & Asylum Chamber), [2017] CSIH 52.

The appellant claimed to be a homosexual from Pakistan. The case had a long running history where the appellant had initially been successful but in subsequent proceedings that decision had been overturned. Leave to appeal was granted on the basis there was a compelling reason in terms of how the documents had been assessed and the lack of any assessment of the evidence of the witness. In the substantive appeal the Inner House agreed that there had been an error in how the documents had been assessed and also there had been an error in light of the absence of the any substantive examination of the evidence of the witness.
