Roddy McIlvride of Terra Firma Chambers appeared for the successful pursuers in a debate before Lord Menzies in Scottish Power Energy Retail Ltd v Taskforce Contracts Ltd [2008] CSOH 110 in which it was held that a commercial agent had no entitlement to an indemnity under regulation 17 of the Commercial Agents (Council Directive) Regulations 1993 in circumstances where the agent had been instructed to cease performing the activity which generated the majority of its income but the contract of agency had not been terminated.
