Terra Firma Chambers’ Mark Lazarowicz and Brian Crook will be speakers at the New Rights for Communities to Buy Land and Acquire Public Assets seminar on Mon 29th January 2018 at Riddles Court, Edinburgh.
This seminar will outline the new community rights to buy land and acquire public assets, introduced by the Community Empowerment (Scotland) Act 2015. It will look in detail at the legislation, statutory guidance, case law, how applications can be submitted, the rights of landowners and public bodies, and the experience to date of the way that the new rights have worked in practice.
Mark Lazarowicz will provide an overview of the new rights for communities to buy land and acquire public assets. His talk will consider the extension across Scotland of the community right to buy land under the Community Empowerment (Scotland) Act 2015 and look at case law and how the new right works in practice.
Brian Crook’s talk will cover the new community right to request asset transfer. The new legislation gives a right to a wide range of community bodies to request public bodies in Scotland to transfer their assets to the community. Details of the legislation, how requests can be submitted, and the principles which public bodies are required to apply when considering requests will be discussed.
