Inner House Rules That Landlord Can Demolish Property Subject To Repairing Standard Order

Nicholas Charlton v The Josephine Marshall Trust [2020] CSIH 11

Terra Firma’s Alasdair Burnet successfully represented the respondent in an appeal to the Inner House of the Court of Session against a decision of the Upper Tribunal to grant a repossession order in respect of a property over which the appellant had an assured tenancy.

The appeal dealt with the relation between orders for possession of a house let on an assured tenancy under s.18 of the Housing (Scotland) Act 1988 and a Repairing Standards Enforcement Order granted under s.22/24 of the Housing (Scotland) Act 2006.
