Denis Edwards will deliver a Judicial Review Update to the Royal Faculty of Procurators in Glasgow on 27th February, 2024.
The judicial review update seminar aims to provide an overview of the latest developments in the field of judicial review. It will discuss developments relating both to judicial review procedure and the scope and grounds for judicial review.
The last few years have seen a significant number of significant judicial review cases, in Scotland and elsewhere in the UK. Some themes include the duty of candour in judicial review cases, the intensity of the court's scrutiny of challenged decisions, the scope of legitimate expectation claims and the rules relating to the lawfulness of policies. In addition, there is continuing effect of EU law, by whichever name it is now called, which is likely to exercise the courts for some time to come.
Denis Edwards is an Advocate and Barrister, practising from Terra Firma in Scotland and Temple Tax Chambers and Normanton Chambers in England & Wales. He has appeared in several leading cases decided by the House of Lords and UK Supreme Court and is the co-author of Clyde & Edwards Judicial Review and, with Professor Stephen Thompson, the latest re-issue of the Administrative Law title of the Stair Memorial Encyclopaedia. He is also the vice-chair of the Statute Law Society.
