Terra Firma Chambers are pleased to announce the imminent publication by W Green of the first commentary, Arbitration (Scotland) Act 2010 of which Terra Firma member David Bartos F.C.I.Arb. is co-author with Professor Fraser Davidson of Stirling University and international arbitrator, mediator and expert determiner Hew Dundas. The Arbitration (Scotland) Act 2010 which comes into force on 7 June 2010 marks a revolutionary modernization and codification of the law of arbitration in Scotland. It has drawn on the best features of the arbitral laws of other jurisdictions as well as the UNCITRAL Model Law on international commercial arbitration.
In the foreword to the book, John Campbell Q.C., President of the Chartered Institute of Arbitrators in 2009 writes:
“This first commentary on the Act of 2010 by Professor Fraser Davidson, Mr Hew Dundas and Mr David Bartos shines a bright light on the intricate, yet elegant provisions of a powerful and articulate code. The work is easy to understand and easy to use. By the clear exposition of principle yet drawing on the vast body of available precedent and teaching it enables us to call on the developed skills and practice of the entire world, taking Scotland’s aspirations for this vital commercial activity forward by a giant leap. . . . All three authors must be warmly congratulated for the giving of their time and experience, and for the speed and diligence they have applied to a work which will turn out to be indispensable to practitioners, men and women of business, teachers, students and indeed to all those with an interest in private and public law.”
This publication confirms the quality of arbitration advice, representation and arbitration services within Terra Firma Chambers and within its new arbitration group, TFArbitration (TFArb).
